    Terms of Use

    Using The Pact means entering an agreement — with us, and with yourself. These terms govern that relationship. Please read them. They are written to be understood, not avoided.

    1. Who These Terms Apply To

    These Terms of Use ("Terms") apply to anyone who accesses or uses The Pact, including the website at thepact.io, the macOS application, and any related services (collectively, "The Pact" or "the Service").

    By downloading, installing, or using The Pact, you agree to these Terms. If you do not agree, do not use the Service.

    2. What The Pact Is

    The Pact is a macOS application that enforces structured recovery sessions during your workday through system-level screen locking, calendar integration, and behavioral accountability tools.

    The Pact is not:

    • A medical device or health monitoring tool
    • A substitute for professional medical, ergonomic, or psychological advice
    • An employee monitoring or productivity surveillance tool

    The recovery protocols included in The Pact — Posture Reset exercises and NSDR sessions — are general wellness practices intended for healthy adults in desk-based work environments. They are not medical treatments.

    3. Eligibility

    You must be at least 16 years of age to use The Pact. By using the Service, you confirm that you meet this requirement.

    4. Your Account

    You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@thepact.io if you suspect unauthorised access.

    5. Subscriptions and Billing

    Enforcement: Billed monthly at $12.99 or annually at $99. Includes a 7-day free trial. You will not be charged during the trial period. Cancel before the trial ends to avoid being charged.

    Payments are processed by third-party payment providers. We do not store your payment details.

    Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer partial refunds for unused periods except where required by applicable law.

    Refunds: If you experience a technical failure directly attributable to The Pact that we are unable to resolve, contact support@thepact.io and we will review your case.

    6. System-Level Access & Kiosk Mode

    The Pact operates at the system level. By enabling Kiosk Mode, you acknowledge and accept that:

    • The application will temporarily restrict access to your screen, keyboard shortcuts, application switching, and system navigation during active recovery sessions
    • This behavior is intentional and is the core function of the Service you have chosen
    • The SOS Bypass is available for genuine emergencies and requires a deliberate 5-second hold and written justification to activate
    • You remain responsible for your device and for ensuring The Pact is not used in environments where system-level restrictions could cause harm or violate third-party policies (e.g., corporate device management policies)

    If you are using a device managed by an employer or institution, it is your responsibility to confirm that installing and operating The Pact is permitted under your organisation's device policy.

    7. Calendar Integration

    Connecting your Google or Outlook calendar is optional. If you choose to enable Calendar Sync:

    • You grant The Pact read-only access to your calendar availability data
    • You confirm you have the right to connect the calendar account in question
    • You understand that The Pact reads event timing only — not titles, content, or attendee information
    • You may revoke this access at any time through the app or your Google/Microsoft account settings

    8. Acceptable Use

    You agree not to:

    • Reverse engineer, decompile, or attempt to extract the source code of The Pact
    • Use the Service in any way that violates applicable law or regulation
    • Attempt to circumvent the enforcement system through technical means beyond the override mechanisms provided
    • Share your account credentials with others
    • Use The Pact on devices you do not own or are not authorised to modify

    9. Intellectual Property

    All content, design, code, and copy within The Pact — including the application, website, and associated materials — is owned by The Pact and protected by applicable intellectual property law.

    Your use of the Service does not grant you ownership of any part of it. You may not reproduce, distribute, or create derivative works from any part of The Pact without prior written permission.

    10. Disclaimer of Warranties

    The Pact is provided "as is." While we work hard to maintain a reliable and secure service, we make no guarantees that:

    • The Service will be available at all times or free from errors
    • The recovery protocols will produce specific health outcomes
    • The enforcement system will be compatible with all macOS configurations or third-party software

    Use The Pact as one tool within a broader approach to your health and wellbeing. It is not a substitute for professional advice.

    11. Limitation of Liability

    To the maximum extent permitted by applicable law, The Pact and its team shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service — including but not limited to loss of data, loss of productivity, or physical discomfort.

    Our total liability to you for any claim arising from use of The Pact shall not exceed the amount you paid us in the 12 months preceding the claim.

    12. Changes to the Service

    We may update, modify, or discontinue features of The Pact at any time. Where changes are material, we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.

    13. Termination

    We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app or by contacting support@thepact.io.

    14. Governing Law

    As The Pact is not yet incorporated in a specific jurisdiction, disputes will be resolved under the laws of the Netherlands as a default, unless otherwise required by the laws of your country of residence. We are committed to resolving disputes fairly and directly — contact us first at support@thepact.io before pursuing formal proceedings.
